Senate committee advances bill making assault on public officials a class C felony, expands protected categories

The Senate Judiciary Committee voted to give SB 20 a favorable report after adopting an amendment that expands protections to include certain health-care workers.

Senator Chris Elliott introduced the bill, saying it "makes a class C felony, assault in the second degree if you assault a public official," aligning public-official protections with existing provisions for EMS, firefighters and police. Senator Weaver offered an amendment to include pharmacists and nurses who work outside clinical settings; Senator Coleman Madison asked the committee to add social workers who go into homes and work with the Department of Human Resources, and sponsors agreed to address that addition on the floor if necessary.

Opponents voiced philosophical concerns about creating special categories of protected people. Senator Albritton said he worried about "creating another specialty class of people," and that the law should emphasize intent and consequences rather than expanding protected categories. Senator Stutz recorded the committee's lone "no" vote on the final roll call.

Chair closed debate after the amendment passed and the bill was reported favorably out of committee. The committee recorded the amendment vote and the final passage; the chair announced the bill will return to the floor for further consideration.

The committee did not adopt language in the hearing to limit application by job title beyond the amendment text; sponsors said they will work with colleagues to finalize precise definitions before floor action.

The committee adjourned after completing the day's agenda.
