A Rush Valley planning and zoning commission meeting on Jan. 7 resulted in tabling a building-permit request for a permanent cover between two conex (shipping containers) at 85 East Heather Way until the applicant provides documentary proof that the affected parcels have been consolidated.
Applicant Tandy Coyle identified herself on the record as “Tandy Coyle, 85 East Heather Way.” Commissioners and staff reviewed parcel maps and discussed whether the roofed assembly converts movable conex units into a permanent structure subject to standard building and setback rules. Staff noted the property is recorded in multiple parcel entries (one parcel listed as 1.9 acres and another as roughly 0.22 acres) and that the lot-line configuration affects the setback multiplier applied to nonconforming lots.
Commissioners described the relevant setback math for nonconforming lots: the side-yard multiplier produced an estimated required setback of about 7.5 feet (with a statutory minimum of six feet), while rear-yard calculations produced larger distances. Commissioners emphasized that, as drawn, the proposed cover crosses a parcel line and therefore the lots must first be combined or a deed submitted showing a single parcel before a final setback determination and permit approval can be made.
Carl Wall moved to table the application until the applicant provides documentation that the parcels have been combined; Paul Bishop seconded the motion and it carried by voice vote. The applicant was advised to consult a title company or county recorder to consolidate parcel numbers and return with a deed showing the combined parcel.
Next steps: the applicant must provide recorded deed paperwork showing the parcels have been consolidated; staff and the commission will re-evaluate the permit and setbacks once that documentation is provided.
