Council approves Olson Orchards amendment after UDOT orders removal of highway access

Perry City Council voted Dec. 11 to approve an amendment to the Olson Orchards development agreement after the Utah Department of Transportation told the developer the previously planned highway access could not remain.
Staff explained that the original plan had shown a realigned Hargas Hill Road connecting to the highway but UDOT rejected that final permit and required that access be closed. To comply, the developer proposes removing the highway access, relocating a single-family lot and stormwater pond, and widening the south side of 3600 South to provide left- and right-turn lanes at the junction with the development. Staff and the city engineer reviewed the revised exhibits and found the intersection widening acceptable subject to updated exhibit notation.
Planning commission recommended approval but included a suggestion that a connection to 1200 West be required in phase 1 to provide an additional outlet for residents; the developer said building that connection in phase 1 would be difficult and costly given grading and utility-extension needs. Council members noted the tradeoff between requiring the developer to construct an expensive connection early and the benefit of additional outlets for traffic, and ultimately approved the amendment while directing staff to correct exhibit notations, add missing party (Thomas K. Wood) in ordinance recitals, and clarify stormwater and lot-relocation language.
A motion to approve Ordinance 25U with those clarifications carried on a roll-call vote with Council members Young, Walker, Osler, Wright and Tueller voting yes. Staff will renotice the final public hearing materials and return corrected exhibits for recordation.
