Oakley council authorizes staff to negotiate development agreement for City Center

Oakley — After extensive discussion and questions about phasing, team composition and transparency, the Oakley City Council voted to accept the planning commission's referral on the City Center project and authorized staff to begin preparing a draft development agreement.
City planner Stephanie summarized the project's long history of public input and multiple site-plan amendments and said the planning commission voted to send the matter to council "for evaluation and with the understanding that potentially we would start the development agreement process." City attorney Lisa Baskin told the council the city owns parcels implicated in the project and that legislative action is therefore necessary to resolve land-use and parcel questions: "Therefore, the better approach would be to step back and have the city council direct the developer, the planning director, council to sit down and come up with a proposal," she said.
Council members asked whether the council should hold a work session with the planning commission before moving forward and whether the development agreement could be phased. Counsel and staff said both were options: the council could table action, hold a work session, or authorize a working team to develop an initial draft for subsequent review by the planning commission and the council. The council voted to adopt the planning commission's recommendation and then separately voted to authorize city staff, the city attorney and the developer to prepare a draft development agreement, taking into account the planning commission's concerns.
The authorizations allow staff to begin formal negotiations and to return to the planning commission and council with a draft development agreement and associated public hearings. Council directed that work sessions and periodic briefings occur so the planning commission's input is not lost during drafting.
