Applicant seeks annexation and rezoning for 19.9-acre Sixes Road development; variances requested

An applicant listed in submitted materials as Brockbuilt Homes LLC (appearing elsewhere in the record as Brockville Homes LLC) presented a pre-application for annexation and rezoning of about 19.9 acres off Sixes Road in Cherokee County.
Speaker 3, a staff member, said the proposal would rezone tax parcels 063 and 064 (Plat 15 and 09) from R-40 (single-family residential estate, county) to a city traditional neighborhood development (TND) and build a mix of housing and amenities. "The proposed development does consist of 46 single-family detached homes and 132 single-family townhomes with proposed density of 8.94 units per acre," Speaker 3 said. The plan includes an amenity area with a clubhouse, swimming pool and racquetball courts.
The applicant asked for several variances to local standards. As described by staff, requests include eliminating or reducing the 40-foot zoning buffer required between PRD/TND and R-40 districts under Holly Springs zoning ordinance Article 9 (section 9.4), reducing minimum lot size within the TND from 5,000 to 4,800 square feet per Article 7 plan development district standards (table 7.01), reducing a side setback on Lot 30 from 5 feet to 2 feet and reducing a street-side setback in one example from 30 feet (right-of-way) to 14 feet. Staff also said the applicant proposes to reduce the 50-foot undisturbed Holly Springs stream buffer to accommodate a road and sidewalk near Lot 30.
Commissioners asked staff to clarify how setbacks translate into distance between homes and compared the proposal to nearby developments. "We have properties, Pebblewood Grove, Turner Village, Owen Preserve. Those are all similar with 3 feet between. These would be 4 feet," Speaker 3 said when describing spacing. Commissioners confirmed the site is inside the city's growth boundary and noted adjacent land uses: an employment/commercial designation to the north and R-40 county residential to the south (Falls of Cherokee).
On density, staff noted R-40 allows roughly 1 unit per acre, while TND allows up to 8 units per acre; the applicant requested 8.94 units per acre, slightly above the stated TND cap. Staff also said a traffic study has been submitted and is being revised to include a school on Sixes Road; the updated traffic study and other materials will be available at the advertised public hearing on January 15.
No formal vote or recommendation was taken at the pre-application meeting. Speaker 1 called for a motion to adjourn at the end of the session; a motion and second were recorded and the commission voted aye to adjourn. The project will return for a public hearing where the applicant and members of the public may speak.
