At a Holly Springs City planning work session, commissioners reviewed multiple conditional‑use permit (CUP) applications for CBD/hemp/THC and tobacco specialty retail operations. Unidentified Speaker 1 read seven CUP items (B–H) for properties at addresses including 727 Hickory Road; 2240 Holly Springs Parkway Suite A; 5335 Holly Springs Parkway Suite 103; 6115 Hickory Flat Highway Suite 105; 2200 Holly Springs Parkway; 6244 Holly Springs Parkway Suite A; and 2619 Holly Springs Parkway.
Unidentified Speaker 2 described the applicant mix as mostly existing tobacco stores, convenience stores or gas stations that must now apply for CUPs to continue selling hemp/CBD products; "If they don't have [a CUP] by the end of the year, then on January 1, they can no longer sell it," Unidentified Speaker 2 said. Staff noted that Kroger, Publix and Walgreens had not applied, while Walmart filed to reserve rights potentially to sell certain edible products.
Commissioners asked about proximity and clustering. Unidentified Speaker 3 asked about distances between outlets and their proximity to religious institutions and daycares; staff said a report for November will include a table showing measured distances and proximity to restricted areas. Unidentified Speaker 2 clarified that proximity to churches or daycares "would be a valid point to deny" an application and referenced the ordinance’s parameters and the council’s ability to grant variances in some cases.
Unidentified Speaker 2 also noted a state‑law limitation on liquor stores selling these products and said the liquor stores are prohibited from selling them under state law. "The liquor stores, in case anybody was wondering, are prohibited from state law from selling it," Unidentified Speaker 2 said. Staff also spoke about previously denied applicants and grandfathered retailers (for example, a shop staff called "Smokestum" was described as grandfathered for some products based on earlier records).
Next steps: staff will include a distance/proximity chart in the packet, confirm which establishments are grandfathered or previously denied, and route the CUP applications to public hearing and council for final action. No CUPs were approved or denied at the work session.
