Planning commission adopts zoning change requiring conditional-use permits for hemp and THC retail

The ordinance text as described at the hearing adds language that "any grocery store, supermarket, convenience store, or similar retail use that offers as an ancillary use hemp or THC retail products for sale shall be required to apply for a conditional use permit to allow the sale of these products," according to Speaker 3. Staff indicated separation/proximity rules remain in effect and an editorial clarification was added to a table to make 'greater than' thresholds explicit.
Speaker 3 said the changes would be effective upon adoption and that staff will notify businesses: "As soon as council adopts this, we'll send out letters to everybody notifying them." The presenter also told the commission that businesses with existing inventory may sell those products through September but that any business without an approved conditional use permit must cease sales on Oct. 1. Commissioners discussed that several small retailers and gas stations currently sell hemp/THC products and staff estimated about four full establishments but did not provide a comprehensive inventory of sellers.
