Holly Springs planning commissioners voted to deny a conditional-use permit request for a tobacco/CBD and tobacco specialty store at 2271 Holly Springs Parkway (Suite 105).
Planning staff told commissioners the business operated previously as a legal nonconforming retail tobacco shop but that the proposed addition of THC and hemp products would be an expansion of the nonconforming use, triggering the need for a conditional-use permit. Staff noted the property sits about 2,000 feet from another CBD store that had been grandfathered and recommended denial. "This property is very close to another existing CBD store that was grandfathered in...So as it sits, the store can sell what they're currently selling...But you would need to vote if you wanted to approve for them to add the THC and the hemp products," planning staff said.
The applicant’s representative said the shop has operated for more than three years and sought the CUP to expand into CBD/THC products to attract customers. "We're just requesting a conditional use permit, to operate a vape and smoke shop in Holly Springs, Georgia...we're just planning to bring [CBD/THC] in," the applicant said.
After brief discussion, a commissioner moved to deny the CUP; the motion was seconded and the commission voted in favor, denying CUP0102025.
The denial preserves the business’s existing nonconforming tobacco retail privileges but blocks the proposed product expansion into THC/hemp and related accessories under the current application.
