The mayor told the commission she would abstain from the matter after disclosing that her husband has an agreement to rent parking spaces to the business. The mayor said she would not participate in discussion or the vote on the item. The commission considered and approved a procedural motion to permit the mayor’s abstention before proceeding with the extension vote, which passed by roll call.
City Manager Jeff Shipman told the commission the conditional permit was originally issued on March 6, 2024, and that the applicant had been prevented from opening by parking and engineering issues. Shipman said the applicant has a one-year lease for off-site parking with a nearby business as an interim measure and that engineering plans show on-site parking is part of the applicant’s future build-out. Staff said stormwater/sewer work remains to be completed but that these issues are being addressed and the business expects to open later in the year.
Commissioners pressed staff about contingency plans if on-site parking is delayed beyond the one-year lease. Staff reiterated that the off-site lease is limited to one year and that the applicant intends to provide on-site parking as shown in submitted engineering plans. The commission referenced city code cited in the packet (24.117 section 7.d) as the ordinance authority for granting the extension.
The extension was approved by roll call; the mayor was recorded as abstaining and did not participate in subsequent discussion of the matter.
Next steps: The applicant must complete the engineering, stormwater and parking work required for a final certificate of occupancy within the extension period, or seek further action if additional time is needed.
