Fayetteville City Board of Adjustments approves minutes, tables South Raceway Back Road application and notes withdrawal of 925 North Oak Drive item

The Fayetteville City Board of Adjustments on Sept. 8, 2025 approved minutes from its Aug. 4 meeting, voted to table an application for South Raceway Back Road until the Oct. 6 board meeting at the applicant's request, and recorded that a separate request for 925 North Oak Drive was withdrawn for inadequate public notification.
Unidentified Speaker 2 moved to approve the Aug. 4 minutes and Unidentified Speaker 1 seconded; the chair recorded the motion as carried. "Motion to approve carries," the chair said following the roll call.
On the South Raceway Back Road item (BOA20250016), the board formally considered a request from the applicant to delay action until the Oct. 6 meeting. Unidentified Speaker 1 said, "In our agenda, it states that the applicant has requested to table this item until the 10/06/2025 board of adjustment meeting." The motion to table was moved and seconded and, after a roll-call vote in which all members present voted in favor, the motion carried. Staff advised the board the applicant is "working with staff on some of the on-site questions" and that staff expects to provide a full packet at the next meeting.
Separately, staff reported that BOA20250017, an item for 925 North Oak Drive submitted by "Penning's," had been withdrawn because public notification requirements were not met. As Unidentified Speaker 2 put it, "public notification was not properly completed, so it's basically been withdrawn." The board confirmed that no vote was required for the withdrawal.
The board had no further announcements. The chair noted that bylaws remained to be signed and closed the meeting.
Next steps: BOA20250016 will return to the Board of Adjustments agenda on Oct. 6, 2025 with a staff packet expected to include additional on-site information; BOA20250017 will not proceed until the applicant completes required public notice.
