The Stayton Planning Commission on Sept. 30 approved a preliminary partition plan for property at 313 North Evergreen, granting Cardboard Box LLC and Ross Boscher authorization to proceed with the preliminary plan and adopting the draft order presented by staff.
The vote followed staff and applicant summaries in which the parties described negotiated changes to conditions including a narrowed non-remonstrance agreement that would apply only if a full right-of-way reconstruction is required, flexible sidewalk-width standards to be determined by the public works director, and dedication language for right-of-way. Chair Larry McKinley complimented recent improvements nearby, saying, "I compliment you on the improvements on the house on the corner of Ida and Evergreen," and concluded the modifications make the lot "a much more usable space."
Commissioners asked technical questions about sidewalk width and public utilities; staff and the applicant's engineer (Levi) said they could work with public works to set the final dimensions and clarified that the non-remonstrance agreement was reworded so property owners would not be responsible for piecemeal street reconstruction. With no further deliberation, a motion to approve the preliminary plan and adopt the draft order was seconded and carried by voice vote. The commission noted the decision may be appealed to the city council within 14 days of the mailing of the notice of decision.
The action authorizes the applicant to proceed under the terms of the approved preliminary partition and draft order; implementation details such as final sidewalk dimensions and any right-of-way work will be resolved through required permits and public works review.
