Council approves modified reading of ordinance to align ZBA procedure with state law

The Clawson City Council on Nov. 18 voted to advance an amendment to the zoning ordinance intended to align the Zoning Board of Appeals (ZBA) procedures with the Michigan Zoning Enabling Act.
Staff said the city'9s current ordinance language requires four concurring votes for certain ZBA actions, while the state law requires a majority of board members. "Our current language requires 4 members of the ZBA to vote in favor of a request, while the Zoning Enabling Act states that a majority of the board is required," staff told the council. An attending councilmember pointed out an internal text reference that still specified "concurring vote of 4," and staff agreed that the record would be updated and the item would return for another reading.
Council voted in favor of advancing the amended language (recorded as a modified first reading in the Nov. 18 minutes) and asked staff to correct the ordinance text to reflect the state standard before final adoption.
