Planning commission recommends approval of Morningside final plat after staff says conditions met

The Planning and Zoning Commission voted Jan. 29 to recommend approval of the final plat for the Morningside Addition Subdivision Phase 1A, a 23.587-acre project that will create 110 residential lots and three common areas.
City planner Miguel Inclan told the commission the plat had been conditionally approved at the commission’s December meeting but that the City Attorney later prevented the City Council from acting on the item at its Jan. 12 meeting. "Per the Texas local government code, when a plat is approved with conditions, it has to come back to the same body that approved it with conditions, to verify that the conditions have been met," Inclan said. He added the condition — acceptance of required street and infrastructure improvements — had been satisfied and the city engineer completed a walk-through and accepted the work.
Those findings led staff to recommend the commission forward a recommendation of full approval to the City Council. A commissioner identified in the record as Patrick moved "to recommend approval of the final plat of the Morningside Subdivision Phase 1A as presented." The chair seconded; the motion passed on a voice vote. Vote counts were not specified on the record.
The commission record lists the subdivision as being on the west side of Main Street (FM 5487) north of Hubbard. Staff emphasized the special session was requested so the developer would not face an additional delay after the procedural issue at City Council; staff said the City will work to avoid accepting plats with outstanding conditions in the future.
The commission’s recommendation will be forwarded to the City Council for final action at a future meeting, with staff indicating the item is expected to appear on the February City Council agenda.
