The Chula Vista Elementary School District Board conducted a second reading and then adopted an ordinance authorizing the levy of a special tax within Community Facilities District (CFD) No. 10, a Mello-Roos-style financing mechanism for new developments.
Chief Business Officer Mr. Pong explained the ordinance completes the levying process in the CFD area; the staff presentation said the special tax mechanism is commonly used in new developments to finance infrastructure and school needs. Trustee Fernandez and other board members questioned the levy's effects on homeowners, highlighting concerns that unpaid special taxes become liens and that the levy can remain in place for up to 25 years as written in the ordinance materials.
Trustee Fernandez said he "cannot in good conscience approve levying an additional tax on the very people we were elected to represent" and noted the foreclosure risk language described in the attachments. Other trustees moved and seconded the title-only reading and subsequent adoption motion. The board approved reading by title and then adopted the ordinance; the transcript records aye and nay votes during the motions and adoption (vote recorded as carried). The ordinance title was read into the record and the matter was closed.
The board's action completes the district's role as the legislative body for CFD No. 10; the ordinance will be enforced according to the provisions printed in the posted materials and applicable state law.
