Summary
The Zoning Commission approved a modification without a hearing to expand permitted uses in an approved PUD at Square 346, enabling the applicant to lease space to Netflix; the ANC initially opposed but later supported the request and OP recommended approval.
The Zoning Commission voted 5–0–0 to approve a modification without a hearing in zoning commission case 00-33B (Jamal's Carewoody's LLC), allowing the expansion of permissible uses in an approved planned unit development at Square 346 so the applicant can lease office space to Netflix.
Office of Zoning staff told the commission the applicant sought to modify condition number 3 of Zoning Commission Order No. 940 to expand allowable uses and accommodate a leasing opportunity with Netflix; OP recommended approval (Exhibit 5). Staff said ANC 2C initially opposed the request but after applicant outreach it submitted a follow-up report showing unanimous support (Exhibit 8).
Chair Anthony Hood moved to approve the modification and Commissioner Wright seconded. Vice Chair Miller and other commissioners praised the applicant’s efforts to activate a long-vacant retail/frontage area and said the tenant would support downtown revitalization. Michelle (Office of Zoning staff) called the roll; Commissioners Hood, Wright, Miller, Stidham and Imamura recorded 'yes' votes and the commission approved final action. Staff advised a summary order may be submitted in two weeks.
