Council adopts contingency eminent‑domain resolution to keep 3rd Street grade‑separation project on schedule

The City Council on July 1 adopted a resolution finding public interest and necessity to acquire real property interests needed to build the federally funded 3rd Street grade separation project.

Staff said the project — Federal Project Number 5058081 — will construct a railroad underpass at Third Street and the BNSF tracks, lower the street and build a rail conveyance bridge. To construct the realignment and associated slopes, retaining walls and utility relocations, the city identified required property interests: a street and highway easement, sewer facilities easement, temporary construction easement and temporary access easement. Staff reported an appraised value for the interests of $1,509,000.

"The project will improve safety, eliminate significant delays, and improve access for emergency vehicles," the presentation said. Staff noted escrow on a purchase and sale agreement had opened and funding for the purchase had been placed in escrow; the eminent‑domain resolution was presented as a contingency to ensure construction could begin in 2026 if negotiations faltered.

Council held a hearing, received no public speakers, and unanimously adopted the resolution and authorized the city attorney to prepare eminent‑domain complaints if necessary.

Next steps: With the resolution adopted, staff said it could proceed with acquisition activity and continue coordination with BNSF and federal grant managers to keep the project on its schedule for construction in 2026.
