Commissioners approve vacation of alley for McKinley Elementary, waive application fee with recording holdback

The Fremont County Board of Commissioners voted to vacate a 16-foot alleyway platted through Lots 19–28 of the Macon Subdivision that crosses McKinley Elementary, approving vacation of public right-of-way case 25-001 and waiving most application fees while withholding funds for recording.

Scott Morton, identified as Director of Operations for Cañon City Schools, told the board a site survey completed as part of a school gym addition showed the alley runs through the developed school property and is not used for transportation or utilities. Planning staff (Dan) recommended approval and supported a waiver of the application fee with a partial refund, while retaining an amount to cover recording costs.

Commissioner Grantham moved to approve the vacation and to waive fees, specifying withholding for recording costs; the chair seconded the motion. Roll-call votes by Commissioners Grantham and Bell were recorded as "Aye," and the motion carried.

The staff report described the area proposed for vacation as approximately 0.193 acres (a 16-foot alley) affecting several lots where McKinley Elementary was constructed; Planning noted that the alley serves no transportation or utility function. The board discussed fee handling: staff recommended retaining funds to cover recording; during discussion a commissioner corrected the recording fee amount in the record. The motion as adopted included the fee waiver with the withholding for recording as stated on the motion record.

The county clerk will record the vacation and update property records. No public speakers objected during the hearing.
