The City of Atlanta Zoning Committee on Jan. 30 approved a set of ordinances, amendments and referrals affecting neighborhoods across the city.
The committee approved an amendment to the land development code (Item 7) allowing 6-foot walls and fences in half-depth front yards in single-family zoning districts in the Riverside neighborhood. The item was moved by the chair at the district councilmember's request, seconded by Vice Chair Collins and Councilwoman Bakhtiari, and the committee recorded the vote as 6 yeas, 0 nays.
In a contested rezoning (Item 11) for properties at 1911 and 1917 LaDonne Lane and 1920 Ann Street NW, the committee considered a main motion to deny (the “adverse” motion) and a substitute motion to approve. Councilwoman Liliana Bakhtiari (substitute mover) and Councilman Westmoreland (second) advanced the substitute, which passed 5–1, making the item favorable.
At the request of a district councilmember, the committee held Item 10 (rezoning for properties along Sylvan Road and Cox Avenue near the BeltLine overlay) rather than vote on it. The committee also filed Items 8, 22 and 29 (special-use permit requests for a community center, a personal care home and an outdoor sales area) after a motion to file passed 6–0.
A larger group of items (12, 13, 15, 19, 20, 21, 23, 25, 26, 31 and 33–40) was referred to the Zoning Review Board for hearings, with the committee voting 7–0 to send those items to the ZRB. Several of the referred items concern rezonings in Vine City and Westside neighborhoods and proposed code amendments tied to those areas.
Item 43 (rezoning for property at 599 People Street SW) came with a day-of amendment clarifying the property address; the amendment was adopted and the item approved as amended (vote recorded as 7–0). Items 16 and 17 (rezonings for Nathan Road and Lennox Road properties) were approved 7–0.
Chair and council members reminded the public that referral to the ZRB opens the formal public-comment period for affected projects. The committee adjourned after closing remarks.
