The council handled two separate appeals Aug. 19 by neighborhood councilmembers seeking to overturn planning commission approvals of Type‑2 short‑term rental conditional‑use permits (CUPs) for 421 and 463 West Iowa Street.
Mark Kenyon and neighborhood residents argued the two CUPs would undermine the historic, family‑oriented character of the Wilson Park neighborhood, raise parking and public‑safety concerns and contribute to a perceived saturation of short‑term rentals (STRs) in the quarter‑mile area. Kenyon cited municipal code sections governing neighborhood compatibility, ingress/egress and home protection standards and questioned whether the properties could meet off‑street parking requirements for the number of bedrooms proposed.
Applicant Michael Marsh, who owns both homes, said the properties were renovated and intended for family stays, not parties; he described on‑site parking plans and operational rules (three‑night minimum, age limits, host contact and on‑site parking layout). Marsh said he and his family would use the homes personally as well.
Public comment included neighbors who said the neighborhood is already heavily impacted by visitors, sorority activity and parking pressure; other speakers supported the applicant and noted similar nearby STRs.
Council vote outcomes: On 421 West Iowa, the motion to grant the appeal (which would have denied the CUP) failed in a roll‑call split, so the planning commission’s approval stands. On 463 West Iowa the council granted the appeal on a 5‑vote majority, reversing the planning commission’s conditional‑use approval; the council’s resolution denies operation as a Type‑2 STR at 463 under the planning commission’s CUP.
What’s next: The applicant may pursue options available under city code (including reapplication with conditions), and staff will follow up on permit and business‑license processes for any permitted operations.
