Powder Mountain outlines conditions for master plan CUP; commissioners seek final language before December public hearing

Powder Mountain representatives presented a proposed list of conditions for a master plan conditional use permit and a development review flow chart, telling commissioners they had tried to address questions from previous meetings and outside consultants.

Presenter Brooke Consford listed eight draft conditions including interlocal agreements with surrounding agencies (fire, EMS, sheriff), a UDOT traffic‑analysis threshold tied to unit counts (presented as a threshold for a new traffic study), density‑tracking language to monitor future applications, required soil testing and a proposed dark‑sky lighting standard that could reference either Weber County’s code or the International Dark Sky Code (SEG 170–289). Consford said the language was written to encourage but not strictly to compel interlocal agreements so the master plan could proceed while providing incentives and a timeline for partners to finalize service arrangements.

Commissioners and staff pressed for earlier distribution of final conditions and requested legal counsel review; several commissioners asked that staff provide final draft conditions by Nov. 20–24 so the commission would have time to review ahead of a December public hearing (SEG 641–649). One commissioner suggested defaulting to a national dark‑sky code until Cache County could adopt its own standard.

Outcome: The presentation provided direction and drafting guidance; the commission asked staff, the applicant and county counsel to finalize and circulate the proposed conditions before the scheduled December hearing.
