Tenant at 280 Connecticut told vape/tobacco use barred by one-mile rule; matter continued

At the Jan. 29 Norwalk zoning hearing, staff notified the commission that a tenant at 280 Connecticut Avenue had submitted a permit application in November but that the application materials were incomplete.
Staff explained a zoning restriction that creates a one-mile radius exclusion for vape/tobacco shops: because an approved vape/tobacco business on Washington Avenue falls within one mile, a new smoke- or vape-shop use at 280 Connecticut is precluded under current regulations. Staff noted that the tenant could pursue other permitted commercial uses (for example, a deli, bookstore or toy store) but not operate as a tobacco/vape retailer in that location.
The property manager and tenant representatives attended and were told to coordinate with staff; the commission continued the item to Feb. 25 to allow the applicant to either revise the application for a different use or provide additional documentation. Staff warned that operating without final permits could result in daily fines under the citation process.
