The City Utilities Committee voted unanimously on Jan. 30 to grant the Atlanta Botanical Garden an access easement over approximately 13,381 square feet of city property at 1491 Piedmont Avenue NE (listed in the ordinance as the West Property). Marcus Butts of the Department of Watershed Management's Office of Engineering Services told the committee staff had evaluated the request and found no operational conflicts.
The ordinance authorizes the mayor or designee to execute documents granting the easement and waives any conflicting provisions of Atlanta City Code article 10, division 4 cited in the item. Chair Councilmember Hillis moved approval; Vice Chair Bakhtiari seconded. The vote was recorded in the transcript as 7 ayes, 0 nays and the item was favorable.
Butts said the easement will support the comprehensive plan for the Piedmont Park area and allow construction, use and maintenance of an access road on the specified parcel; parcel identifiers and district information were read into the record during the item presentation. There were no public objections during the meeting.
