Cloverdale council approves consent items, addresses potential conflict on small contract and appoints citizen oversight committee

After roll-call approval of most consent items, Council pulled item F5 for public discussion after a councilor disclosed the contract involved his brother, a sole proprietor proposed for an electrical job estimated at about $12,000. The vice mayor stated he had no financial interest and had conferred with the city attorney. The city attorney (unnamed at the hearing) explained that under the Political Reform Act an official must recuse when they have a financial interest; based on the vice mayor’s statements there was no legal requirement to recuse. Staff explained the contractor was selected for availability, familiarity with portable school units, prior pro bono work and current insurance coverage that would expedite completion. The council moved and approved F5 by voice vote.
The council then moved to adopt a resolution appointing Greg Carney, Robert Maddock and Mike Nixon to the three-member citizen oversight committee for Measure DD and the Utilities Users Tax (UUT); the appointment motion passed 5–0.
What’s next: The newly appointed oversight committee will begin duties as required by Measure DD and UUT implementing language; staff will proceed with the contracted work on the portable school buildings.
