The Planning Commission approved Kernishon LLC's conditional use permit and special permits after commissioners pointed out inconsistent dates in the conditions of approval linked to California Department of Fish and Wildlife (CDFW) comments and Lake and Streambed Alteration Agreement (LSAA) revisions.
Commissioner Levy identified dates in the conditions of approval that appeared to be in the past (notably references to 2024) and asked whether required actions, such as submitting and implementing an erosion control plan, had in fact occurred. Staff said CDFW had previously provided comments and the applicant is working with CDFW to revise and extend the LSAA; staff acknowledged a missed date in the draft COA and recommended correcting the condition to align with other 2025 deadlines.
Commissioner Levy moved to approve the Kernishon LLC permits with a simple correction to Condition of Approval 12(c) to reflect the correct 2025 date; the motion was seconded and passed unanimously by voice vote.
Staff noted remaining coordination with CDFW and that the applicant would submit a major LSAA amendment by 05/31/2025 as reflected in the corrected condition.
