TCEQ moves MSGP 2026 renewal forward after EPA 90‑day review approval; draft to public notice Nov. 14–Dec. 15

TCEQ told the Water Quality Advisory Work Group that the agency has advanced the Multi‑Sector General Permit renewal and will open the draft for public comment later this year.
“ On 05/21/2025, TCEQ sent the draft MSGP to EPA for their 90 day review. We received a response letter from EPA on 08/18/2025 with approval to proceed with the issuance of the draft general permit, without comments or revisions,” Jesse Gresalamia, the MSGP project manager, said.
Key changes in the renewal include moving SIC and NAICS code tables to an appendix, updating NAICS codes to the 2022 version, removing SIC code 1231 for anthracite mining (not applicable in Texas), clarifying application submission requirements for discharges to MS4s, allowing electronic SWIFT records, revising benchmark levels based on current data, and adding provisions that prohibit authorization for discharges from facilities licensed for storage or disposal of high‑level radioactive waste under U.S. Nuclear Regulatory Commission rules (10 CFR part 72) consistent with state legislation.
Public notice and comment: Jesse said TCEQ plans a 30‑day public comment period from Nov. 14, 2025 to Dec. 15, 2025, and will publish notice in the Houston Chronicle and the Texas Register. A public meeting is tentatively scheduled for Dec. 15, 2025 at the TCEQ Austin Headquarters, with a first half presentation and a second half for oral comments.
Next steps: TCEQ will consider written and oral comments and may revise permit language if needed before adoption. The MSGP renewal is set to address permit expiration on Aug. 14, 2026.
