OMBC enforcement reports 26% increase in complaints and expanded citation use; 733 cases pending

Christy Libermento, the board's enforcement program manager, told members on Jan. 22 that enforcement intake and active investigations have risen. "So far this fiscal year, we have received a total of 630 complaints and 12 arrest slash conviction notices," Libermento said, describing an approximately 25–26% increase in complaints compared with the prior year.
She reported the enforcement program currently has 733 pending cases, including 134 formal investigations and 20 cases pending at the Attorney General's office. Libermento noted performance measures: intake acknowledgment averaging 5 days year-to-date and case aging metrics that vary by case type.
Staff highlighted an Oct. 1, 2025 expansion of administrative citation authority allowing citations for violations of the practice act that previously only drew educational letters; that authority has resulted in citations being issued in quarter 2 and is expected to increase administrative actions for lower-level violations such as recordkeeping and failure to renew.
Consumer advocates at the meeting welcomed the increase in complaints and urged clearer guidance for complainants about the evidence needed to move cases.
