Delegate Chris Fair presented House Bill 28, which would permit qualifying private institutions and postsecondary schools to begin limited advertising before final certificate of approval if they meet criteria, conduct market surveys, secure locations and receive Maryland Higher Education Commission authorization. To protect students, the bill prohibits enrollment or acceptance of payment prior to final approval.
Fair said the measure passed the committee and the House unanimously last year and that MHEC helped craft the language. He argued the change reduces unnecessary operating costs and financial risk for schools opening new programs while maintaining consumer protections.
Committee members thanked the sponsor and signaled support; no formal vote was recorded in the hearing.
