After limited discussion the commission approved the waiver (recorded as four ayes) and the chair announced the motion carried.
During the public comment period before the hearings, Jesus Hakobapatino introduced himself and said he holds a 50% ownership interest in property at 1459 West Dolphin Avenue (APN 508-01-09117005). "I have not authorized any sale, transfer, or construction on the property," Hakobapatino said, and asked to be notified immediately if the city or a transit or planning agency considers agreements regarding the parcel. The transcript does not record an official response to that request.
The second waiver, for a parcel on North Heritage Drive submitted by Capstone Engineering, would subdivide Parcel 2 of parcel map 6621 into multiple lots with a remainder parcel (3.53 gross acres). Staff said the map conforms to zoning and frontage requirements, qualifies for the same CEQA exemption, and that the remainder parcel would receive a certificate of compliance. Resident Renee West, speaking for the Heritage Village Master Community Association, said she was "in the dark" about the proposal and asked whether ownership had changed and how the remainder parcel would be handled. Staff and the city manager explained multiple parties own the property, the subdivision map act permits a remainder parcel, and subdivision does not itself change construction timelines. The commission approved the waiver on a five-aye vote.
Both approvals included direction for staff to prepare certificates of compliance and obtain reciprocal access and shared-parking agreements to avoid future blocking of access as ownership changes. The commission recorded the first waiver as carried with four ayes and the second with five ayes. The public hearing for both items was closed at 6:16 p.m.
