Cave Creek residents urge council to rescind land-patent activations for Glory Road

Michael Wehner (3375 E. Glory Road) told the council he delivered a formal demand letter seeking suspension of any ongoing exercise of the federal land patents west of 32nd Street and asked the town to revoke its intent to extend Glory Road to 32nd Street. He said Resolution 20-25 was passed without notification to affected residents and said a petition to overturn that resolution was submitted Dec. 15. Citing the 2025 State of Arizona v. Foothills Reserve decision, Wehner warned the town may face proximity-damage claims and constitutional due-process exposure if it proceeds without addressing neighbors’ concerns: “Please reconsider your actions and potential risks to the city and overturn Resolution 20-25 and stop the patent applications while you still can,” he said.
Melissa Ducey (3323 E. Glory Road) recounted a Jan. 14 meeting with the town manager and town engineer and said the town engineer told residents there is no short-term plan to open Glory Road between 34th and 32nd. Ducey asked why the town activated the patents if there was no intent to open to 32nd and urged council to rescind the four patents affecting lots between 34th and 32nd. “Why activate those patents to begin with if the town had no intent of opening the road to 32nd Street?” she asked.
Town staff responded that staff had met with residents, listened to feedback and was working on a compromise. The town manager (unnamed in the record) said staff is planning a follow-up meeting to share options with residents and offered to discuss details individually.
What’s next: Residents asked the council to rescind or narrow the patent activations affecting parcels between 34th and 32nd streets; the council did not take formal action on the request during the meeting and staff said a follow-up meeting will be scheduled to discuss options.
