Eureka council adopts Gulch & Greenway overlay ordinance with insurance and fencing clarifications

Director Kenyon said the overlay adds an additional permitting layer and a ‘Gulch Greenway management area’ with discretionary review for large vegetation removals. He told the council the measure implements a long-standing general-plan policy and reflects changes requested during earlier hearings and workshops.
Council member Moulton moved to add language allowing zoning clearance when vegetation removal is required for obtaining or maintaining insurance; Council member Contreras Deloach seconded. Council discussion focused on measurement standards (horizontal distance vs. slope) and on distinguishing exclusion fences that permit wildlife passage from higher exclusion fencing used to protect children or pets. The ordinance includes a narrower, expedited zoning clearance for cases where insurance coverage would otherwise be lost.
Public commenters and environmental groups supported protections for wetland functions and noted the ordinance’s role in stabilizing slopes, filtering pollutants and reducing urban heat impacts. Humboldt Waterkeeper staff said the redlined revisions improved clarity while retaining protections.
The motion carried; the council recorded three yes votes with two members absent or recused. Staff said the zoning code will be monitored and amended as needed to resolve ambiguous cases.
What happens next: the planning and community services department will implement the permit and zoning-clearance processes and prepare guidance for applicants and insurers.
