TCEQ reports slow-but-steady processing of MS4 applications; MSGP renewal advances with EPA approval

TCEQ staff told the Water Quality Advisory Work Group that processing of Phase 2 (small) MS4 general-permit applications is underway and that the agency is averaging about 50 approvals per month.
"We have approved 269 notices of intent," Rebecca Villalva, team leader for the Stormwater Permits team, said. She said TCEQ has 385 pending applications on hold and that the agency has reviewed a total of roughly 433 applications so far; the majority of approvals required at least one notice of deficiency and many required two rounds.
Rebecca explained that EPA paused development of the NetMS4 annual-report module in April 2025, so TCEQ is accepting paper annual reports for 2024-cycle approvations until the electronic system resumes. She said the revised annual-report template was posted to TCEQ’s website and that the delegation-of-signatory (DAR) form must be submitted electronically via NetMS4.
On industrial stormwater, Jesse Grasalemia said TCEQ sent the draft Multi-Sector General Permit (MSGP) to EPA for a 90-day review on May 21, 2025 and that EPA returned an approval letter on Aug. 18, 2025 allowing issuance without comment. The agency is preparing response-to-comments materials on topics raised during public notice — including PFAS monitoring, public availability of records, STEERS applications, notification to MS4s and benchmarking — and expects to brief management in advance of a late-July 2026 adoption consideration.
Participants asked whether oil-and-gas facilities required to obtain MSGP coverage should wait for the new permit before applying. TCEQ staff said entities currently authorized by EPA need to apply under TCEQ coverage before their EPA authorization expires; new entities can apply now.
