Summary
The commission approved Annexation 723 (Bell Terrace) as a 99%‑surrounded island annexation; Commissioner Fowler reiterated opposition to island‑annexation statute but the commission found statutory criteria met and voted to approve.
Kern LAFCO approved Annexation 723 (Bell Terrace Number 1), an island annexation of roughly 111.33 acres near White Lane and South Union Avenue, following staff findings that the area is 99% surrounded by the City of Bakersfield and meets statutory criteria that limit commission discretion.
Staff said the annexation was initiated by the city on behalf of residents seeking sewer and water and reported no substantive opposition in the record. "This is one of the few areas under state law that doesn't grant the commission discretionary power," staff said when summarizing the mandatory review standards.
Commissioner Barbara Fowler repeated her long‑standing policy opposition to island annexation law but acknowledged the legal criteria were met. “I've stated before my opposition to island annexation law… Well, 99% did,” Fowler said.
Staff said it had completed extra mailings beyond the standard notice to reach owners, noting several property owners live outside the area. The motion to approve carried on a roll‑call vote with six ayes.
What happens next: The annexation will proceed under the conditions recommended by the executive officer and administrative steps required by state law.
