RDA posts additional $5,000 bond for easement condemnation on parcel O2-00A1-1500

The RDA approved posting a $5,000 bond tied to an amended complaint seeking condemnation of a construction easement across the driveway in front of West John (Destron) Resort, parcel O2-00A1-1500.
Staff explained the additional $5,000 supplements an earlier $18,000 bond posted for emergency occupancy and was needed because the amended complaint added a small segment (a construction easement) that was not included in the original bond calculation. "If the judge rules that that's the value of the easement, then it will be applied to payment of the value of the easement," staff said. A motion to post the $5,000 bond was moved and seconded and carried on voice vote.
The bond funds remain with the RDA and would be applied to the property owner if the court determines that valuation; staff said the posted money would not be lost if the RDA complies with terms of the occupancy.
