County attorney: amended condemnation complaint filed; affidavits prepared to seek immediate occupancy

Daggett County staff told commissioners on Tuesday that the county has filed an amended complaint in a pending condemnation action and is preparing affidavits to request immediate occupancy.
“Kent” (staff) said the amended order and amended complaint have been filed and that opposing counsel stipulated to the order allowing amendment. He added: “We don't have a court date yet, but we do have the order the amended order and the amended complaint filed,” and said he is preparing affidavits for Trevor and Matt Lucas so the county can request immediate occupancy once the judge signs the order.
Commissioners did not set a hearing date at the meeting. County staff said if the other side requests a hearing, the county will schedule one; if not, the county intends to proceed with seeking the occupancy authorization after the judge signs the order.
No formal vote was taken on the condemnation items during the discussion. The commission returned to other agenda items after the legal update.
