City staff told the Gunnison City Council on Feb. 19 that a title dispute affecting a parcel on 300 East may require legal resolution and that the city should expect representatives from a title company and potentially lawyers to appear at a future meeting.
Staff said the owner thought his deed included acreage that, according to a survey, contains the city public right-of-way and that the title company is seeking to resolve fence-line and boundary disagreements with neighboring property owners. The staff briefing noted the city’s public-right-of-way designation remains and that the city would retain access to utilities through prescriptive easement even if property lines are adjusted.
Council members asked practical questions about how utilities and improvements would be handled and whether the disputed piece could be classified as an 'insignificant piece' of property — a classification staff said could allow an expedited local process. Staff emphasized no decision would be made until the title company's representatives present details and legal counsel for all parties could be present.
Council did not act on the matter at the Feb. 19 meeting and requested the title company attend a future meeting with partners and counsel to present specifics.
