Commission approves amended Reserve at Swains Creek agreement after split vote

Kane County commissioners voted to approve an amendment to the Reserve at Swains Creek development agreement after hearing project representatives and staff on Sept. 16.
Project counsel described substantive changes: reordering phases so the area previously planned as the last phase becomes phase 1; a reduction in phase-1 lots from 14 to 9; an increase in open space from 11.2 acres to 12.8 acres (raising open-space share from roughly 33% to about 38%); and adjusted lot sizes (some as small as 0.8 acres, others near half an acre in the southern portion). The applicant said the revisions also reduce visual intrusion and spread development farther apart.
Commission debate focused on whether the changes were substantive (staff said they were) and on concerns about a previously approved helipad/ hangar area. One commissioner noted longstanding opposition to locating a helipad in that area, while others said the revised plan improves open space and is the result of a long public process.
The board took a roll-call vote: Commissioner Cabea voted aye, Commissioner Brown voted no, and Commissioner Myers voted aye; the amendment passed.
County staff will incorporate attorney-requested clarifications and track any subsequent phase changes that may require further commission review.
