The Emery County Commission on May 6 voted to ask planning and zoning to meet with LaSalle Stables, Orangeville City and affected neighbors and return a recommended plan of action to address complaints tied to events on land that spans city and county jurisdiction.
Commission members described a range of resident concerns raised to the county: loud evening events, lack of notice for events on the county portion of the property, and reports of public urination and other behavior near residences. County staff explained Orangeville City had approved a conditional use permit for the city portion without notifying the county, and the county only became involved after complaints were filed.
The county attorney outlined possible conditions that could be considered: requiring the business to give advance notice of events to the county attorney or planning staff so the county could review and approve event parameters; requiring the business to install a privacy fence (with costs assessed to the business rather than adjacent homeowners); and limiting evening-event frequency to reduce impacts on neighbors.
A commissioner noted that because much of the activity is on land zoned agricultural in the county, a county conditional use permit for the county portion remains appropriate. Commissioners agreed to send the matter back to planning and zoning to negotiate with both parties and return with a recommendation; the motion passed with recorded Aye votes.
County staff cautioned that any action must consider legal process and that late discovery of the permit may complicate resolution. The commission requested planning and zoning seek a negotiated plan of action before bringing a formal county conditional use decision back to the commission.
