Orderville planning commission tables request to allow long-term camp-trailer residence on Parcel 0-4-78A

At its March 26, 2025 meeting the Orderville Planning Commission tabled consideration of a conditional use permit request from Robert (and Jessica) Tate that would allow occupants to live in a camp trailer on Parcel 0-4-78A for more than two weeks.
Commissioners raised several concerns about the request during extended discussion: whether the application’s use of the word “temporary” conflicts with the ordinance threshold (more than two weeks) that triggers a conditional-use review; whether the site—identified on the commission map as adjacent to a river—has or will have sewer, water or electrical hookups; and whether graywater or blackwater disposal could create public-health or environmental risks.
Commissioner (Speaker 3) said the proposal ‘‘doesn't conform to the land ordinance’’ for full-time residency without utilities. Chair (Speaker 2) noted a health-department letter in the office stating, in the transcript, “there was no evidence of any illegal funding of waste water.” Commissioners debated whether the town ordinance or forthcoming revisions apply and whether graywater is explicitly regulated by state or county codes.
Several commissioners and participants recommended conditions that could be attached to a permit if it were approved—examples discussed included limiting the number of trailers on a property to one, requiring that the property owner be responsible for cleanliness and waste handling, and setting a one-year expiration tied to renewal and compliance. Commissioners repeatedly said they prefer the applicant or an authorized representative to appear at the meeting so the panel can ask questions.
Commissioner (Speaker 3) moved to table the item until Robert and Jessica Tate or a representative could appear; Commissioner (Speaker 1) seconded. The motion passed by voice vote and the chair declared the motion carries unanimously. The commission will place the item back on a future agenda after the applicant appears or provides requested clarifications.
