The Emery County Planning Commission voted to grant conditional approval for a proposed wrecking and scrap-metal operation on private property, contingent on staff preparing and the applicant signing a conditions sheet that addresses environmental protection, rotation of inventory, limits on bulk tire storage and cleanup responsibility.
Staff described the site as a larger parcel (roughly 41 acres) with a 3-acre working area on a slope north of Quichampaw Road and said most activity will be hidden from Highway view by topography and scrub vegetation. Commissioners expressed concerns about drainage toward the river, containment of oils and fuels, long-term accumulation of vehicles and tires, and potential visual impacts to nearby neighbors.
Commissioners discussed specific drafting ideas for conditions, including banning long-term permanent bulk storage, requiring regular rotation of inventory (one suggested interval: reevaluation every five years), prohibiting bulk tire stockpiles, specifying limits on onsite fuel/oil storage, requiring an obscuring fence where the site is visible, and holding the owner responsible for cleanup at end of operations. Commissioners also asked staff to research whether a bond or other financial guarantee can be required on private property and whether insurance/cleanup bonding can be enforced under county authority.
A commissioner moved to allow the applicant to begin operations with the stipulation that staff will prepare a written condition sheet covering the items discussed; the motion was seconded, commissioners voted in favor and staff said they will deliver a conditional-approval letter to the applicant once the paperwork is signed.
The commission emphasized that final issuance and continued use will be contingent on the agreed-upon conditions and any legally enforceable bonding, containment and cleanup provisions staff can identify in county ordinance or state regulation.
