Commission adopts zoning text amendment to allow short-term rentals with rules

The Bismarck City Commission approved a zoning text amendment (ordinance 66-43) to allow short-term rentals on residential properties with conditions intended to preserve residential character and address parking and noise.

Planning Department staff member Lauren explained the ordinance defines short-term rentals, requires that properties maintain a residential appearance, limits the use to permanent residential units, and includes requirements for noise, parking and compliance with the International Building Code. Staff said the draft was informed by a stakeholder group that included the Planning and Zoning Commission, the Convention and Visitors Bureau, the Chamber/EDC, downtown stakeholders and short-term-rental owners; staff also reviewed ordinances from peer cities and planning best practices.

Lauren noted the city collected public input through an online survey and had received several written comments opposing short-term rentals; staff nevertheless recommended approval after evaluating the proposal under the comprehensive plan and state law. During discussion, one commissioner said short-term rentals could provide owners a way to maintain homes and avoid displacement, while another asked about impacts on affordable housing; staff and commissioners discussed these points without changing the ordinance.

The commission moved to approve the ordinance as presented and passed the motion unanimously. Staff said the next steps include finalizing administrative procedures and notice to the public about permitting and compliance requirements.
