The Bismarck Planning and Zoning Commission on Wednesday approved three land-use actions: a minor subdivision final plat in the Miriam Industrial Park, a planned-unit-development amendment to increase maximum height for Saint Mary's sisters, and a special-use permit to allow accessory buildings up to 15,000 square feet in Hay Creek Township.
Isaac (planning staff) described the Miriam Industrial Park minor plat as a 1.42-acre replat to adjust lot lines and add access and utility easements so two existing parcels share parking and access more equitably. Staff said the property is in an MA industrial zoning district and recommended approval. The applicant's representative, Leonard Naimler of Swensenagan Engineering, said the owners wanted to move the lot line roughly down the middle of a shared driveway. The commission moved and voted to approve the minor plat.
Planner Lauren presented a PUD amendment for property owned by the Saint Mary's sisters in west-central Bismarck that would increase the maximum allowable height from 40 feet to 55 feet to accommodate a larger chapel and interior changes. Staff mailed 49 postcards to nearby property owners and reported five written comments in support; the applicant (Mother Mary Joseph) said the change improves interior layout and chapel design. Commissioner Gabe Schell noted that a PUD height change is tied to the approved use and that future different uses would likely require a separate zoning review. The commission approved the PUD amendment.
Planner Jenny presented a special-use permit request from Lonnie Barth to increase allowable accessory structure area to 15,000 square feet on a 71.2-acre agricultural parcel at 2825 River Road, outside the urban service area. Hay Creek Township submitted a resolution in favor of the request. Staff recommended approval and the commission approved the special-use permit.
Each of the three items received a motion, a second and a roll-call vote in favor; no substantive opposition was recorded in the public hearings for these items. The approvals will be processed by staff according to standard plat, permitting and PUD procedures.
