Daggett County’s attorney reported April 1 that the county would file an easement and potential eminent-domain action that afternoon after receiving an email and assembling supporting records.
Kent Snyder, the county attorney, told the commission and Redevelopment Agency that staff "have been waiting for the email from Loretta" and that after retrieving the meeting recording to confirm the item had been tabled previously, "they now have all of it that will be filed today." The chair confirmed the update and said the county has reached out to opposing counsel to ask whether the parties could stipulate to shorten the process.
The update came during the RDA portion of the meeting. Snyder said staff located the email and the recording needed to document that the matter had been tabled on March 11 and continued to Feb. 25, and that the assembled materials are sufficient for filing. He said the county has asked the other side’s counsel to consider stipulating so the county would not have to wait on a response before filing.
Procedural motions earlier in the meeting authorized the commission to go in and out of RDA session to address redevelopment issues; a voice vote approved that procedural motion.
No formal hearing on the easement or a final court filing was taken at the meeting; Snyder’s statement described staff readiness to file the legal papers that day and outreach to opposing counsel about a stipulation. The commission did not vote on the substantive easement action during this session.
