County staff to file extension request to preserve water-rights application 41-3470

Daggett County commissioners on the record authorized county staff to prepare and submit an extension to file proof for water-rights application 41-3470, telling staff to file the request by Oct. 31 to avoid forfeiture.

County staff member Craig told the commission the filing deadline is the end of the month and that extensions to file are routinely approved, but he would add specific reasons in the petition to strengthen the county's case. Craig said the extension would apply to a large portion of the county's water holdings; a commissioner asked whether it covered the county's full allotment of roughly 12,000 acre-feet, and Craig said he believes the extension applies to a “big chunk” and possibly all but that he would confirm the exact water-right identifier later.

The commission asked staff to confirm precisely which water right(s) the filing pertains to and to circulate the filed version once submitted. Commissioners noted the county previously allowed a right to lapse and emphasized avoiding a repeat. The chair entertained a motion authorizing Craig to prepare and submit the extension; the motion was moved and seconded and carried with recorded ayes.

Next steps: Craig will prepare the extension request, ask the county attorney to sign, file it before the Oct. 31 deadline, and circulate a copy to commissioners. Staff committed to confirming the exact water-right number and acreage and reporting back.
