Commission approves easements for South Columbia Drive multi-use path at Legacy

Staff asked the commission to approve easement agreements enabling construction of the South Columbia Drive multi-use path Phase 3 adjacent to the Village at Legacy II development. Staff explained the city has a ground lease with the Decatur Housing Authority for the site, which places the property under the housing authority’s control and therefore requires an easement to perform construction work on the leased parcel.
The staff report noted the Decatur Housing Authority approved the easement agreements at its March 19 meeting and that easement approvals are subject to the housing authority’s project lenders and tax-credit investors completing their review. The commission also approved a related easement agreement with the Decatur Public Facilities Authority (PFA), which originally financed Legacy Park acquisition.
Why it matters: The easements clear a legal step required to build the multi-use path, which will be permanently located on the housing authority parcel and requires temporary construction easements to complete work.
The motions to approve both easement agreements were moved, seconded and approved by the commission.
