Fairfield council approves Industrial Park development agreement, final plat and exempts Comcast hub from water-impact charge

The Fairfield Town Council approved a development agreement and final plat for the Fairfield Industrial Park, located approximately at 400 South Allen's Ranch Road, and voted to exempt a nearby Comcast hub from a water-right dedication and water-impact fee while requiring payment of road impact fees.

The council approved Resolution R2025-15, which Speaker 4 moved 'a resolution approving a development agreement with Fairfield Industrial Park approximately located at 400 South Allen Ranch Road.' The motion passed in roll call with affirmative votes read aloud by the roll-call reader (Laurel, Tyler, Michael, Richard and Holly). Speaker 1 confirmed the printed resolution bears the date 09/24/2025.

Council discussion acknowledged that attorneys for the developer had made requested adjustments to the draft agreement. Staff and council also debated technical and easement terms for utilities. Speaker 3 described a safety concern with an equipment 'beeping' that 'travels a 100 miles' and said staff will test a mitigation: 'we're gonna put a strobe light on the back of the of the equipment so that the light will modify the modem of the magnet.' Speaker 1 thanked staff for addressing the request.

On the final plat, Speaker 4 moved approval; the motion was seconded and the roll-call vote was recorded as all affirmative (RL, Tyler, Michael, Richard, Holly). Speaker 1 explained the town will require signatures and that the building permit will not issue until the recorded agreement is in place.

The council also considered franchise and impact-fee language for a Comcast facility. Speaker 1 said Comcast had returned the language to its attorney and 'we all got the notification saying that it was all good,' but staff had not signed because Comcast must pay franchise fees and address impact fees. Speaker 1 described an approach to allow the hub to be built without dedicating a water share now by recording an agreement against the property; if the property is later redeveloped or ownership changes, the recorded restriction would require dedication of a water share and payment of full water-impact fees.

Speaker 4 moved (and the council approved) a motion to not require Comcast to provide a water right or pay a water-impact fee for its hub at 342 West 645 South Fairfield, noting that the location is 'a hub station that requires no staff or water.' Speaker 1 confirmed the hub will still be required to pay road impact fees.

Council members also agreed to require boring to stay 10 feet off the edge of Allen's Ranch Road and to place the conduit in an easement following the road alignment rather than the straight 'crow flies' line to avoid future costly road realignment. Staff said the developer will be responsible for coordinating with property owners if conduit is placed on both sides of the road.

The council's approvals complete the town-level review but include conditions (recorded agreement on water-rights and payment of franchise and road impact fees) that staff said must be satisfied before building permits are issued.

The council moved on after these votes to other agenda items.
