Davis County Board of Health opens hearing on proposed body art rule changes; scarification and branding prohibition would be removed

At 5:06 p.m., Brandon Hatch, a member of the Davis County Board of Health, opened a public hearing to receive comments on proposed changes to the county's body art regulation. The session was recorded to support a report that will be presented to the board for consideration at its upcoming May meeting.
Hatch said the proposal would repeal the current county body art regulation and reenact a new version that "adopts the new statewide requirements contained in the Utah Administrative Code R392-701, body art, facility sanitation." He added that the draft "removes the prohibition of scarification and branding," a change that would make those practices no longer expressly banned under the county regulation if adopted.
The proposal also updates the fee schedule. Hatch listed new or expanded fees for temporary body art facilities and temporary body art events, follow-up inspections, late fees and plan review fees. He said the proposed changes are intended to align county requirements with the statewide standard and to add fees for services and reviews not previously charged at the county level.
Jay Clark, director of the Environmental Health Division, was present to assist with questions and clarification during the hearing. Hatch asked attendees who wished to speak to sign the attendance roll and complete a request-to-speak form; speakers were asked to state name and place of residence for the record and to limit remarks to the subject of the proposed regulation.
Hatch noted that notice of the hearing had been posted on the Davis County Health Department website, Utah Public Notice website, the Davis County Administration Building and the Davis County Health Department building from March 31, 2025, through April 15, 2025. Written comments and supporting data will be accepted at the Environmental Health Division's offices until 5 p.m. on May 2, 2025; comments received there by that deadline will be considered part of the hearing record.
A report summarizing the hearing will be provided to the Board of Health for its May meeting, at which the board will consider the comments submitted as required by law. Hatch closed the opening remarks by thanking attendees for their participation.
