The Mason City Council on Jan. 19 authorized the city manager to execute a $200,000 settlement agreement in Esquire Construction and Development Company v. City of Mason and approved a purchase agreement with Stone Street Partners LLC for $1,050,000 to develop approximately 56.76 acres for residential housing.
The Esquire settlement was moved, seconded and approved by a 5–2 vote. The council recorded one or more dissenting votes; council minutes indicate the motion passed and staff will finalize the agreement and record the payment.
Council also considered a purchase agreement for city parcel number 3301910351004 with Stone Street Partners LLC for $1,050,000, approving authorization for city representatives to execute the documents by voice vote, 7–0. The agreement anticipates roughly 56.76 acres to be developed into residential housing. City staff and council discussed that the developer will fund the road and underground utility connections necessary to serve the new neighborhood; improvements to some existing portions of Avery Lane may be addressed through a special-assessment process for property owners who benefit from those upgrades.
City manager staff said the internal site-plan and plan-unit-development (PUD) rezoning processes will follow, and that those details — including final design, scheduling and any transition of roads to public ownership — will return to the council during later approvals. The council emphasized that timing for road construction and transfer of public ownership will be part of the final site-plan conditions.
The council approved the purchase agreement 7–0 and recorded the settlement vote as 5–2. No other funding appropriations were approved at the meeting beyond the settlement authorization and the sale transaction.
