Board authorizes acquisition terms for Avenida Del Sur and approves litigation demand against contractors

Following closed executive session, the Board authorized purchase terms for phase 1 of the Avenida Del Sur extension project not to exceed appraised value and authorized the county attorney to make demand and pursue litigation against Missouri Great Dane and Gerling & Associates for alleged breach of contract and related claims.
The Board entered closed (executive) session under attorney-client privilege to discuss acquisition of real property and pending or threatened litigation. After returning to open session, commissioners took two follow-up actions.
First, the Board approved a motion to proceed with the purchase necessary for Phase 1 of the Avenida Del Sur extension project, directing that the purchase price not exceed the appraised value of the interest being acquired plus any damages to the remainder caused by the acquisition. The motion passed by roll call.
Second, the Board authorized the county attorney to issue a demand and bring litigation against Missouri Great Dane and Gerling & Associates alleging breach of contract, breach of warranty and related claims connected to previously discussed public projects. The motion to authorize litigation passed with one abstention; County Attorney noted that the performance-bond company is on-site at the Surya Senior Center and working to complete the facility under an existing memorandum of understanding, but additional litigation steps were authorized as needed.
