Nevada Cannabis Control Board approves multiple license transfers and waivers, delays NCCR 11 changes

The Nevada Cannabis Control Board on Jan. 15 approved a series of ownership transfers and temporary waivers for cannabis licenses, accepted withdrawal requests for two pending transfer applications and postponed consideration of substantive regulatory changes to NCCR 11 to give staff and industry more time to finalize language.

Industry representatives opened the meeting by asking the board to delay action on proposed revisions to NCCR 11. "We are requesting that today's consideration be tabled, indefinitely so that we can continue to work with staff on these matters," said Kimberly Max in Rushton, who identified herself as appearing on behalf of RSR and Local Laboratories. Adam Fulton, also representing laboratory interests, said the labs "fully support" postponing the agenda item while staff and licensees resolve outstanding concerns.

Board staff and members framed the decisions around continued collaboration. "We recommend that we just take this off calendar until we get it done," Deputy Director Michael Miles told the board, saying staff expects to meet with licensees again and then forward finalized language to the Legislative Counsel Bureau.

What the board approved

- Greenway Health Community LLC (TOI 2500026): Members approved an amendment reflecting MMJ Investment Facility's 100% acquisition of Greenway and granted a waiver of NCCR 5.11 for transfers under 5%, with the waiver conditioned to expire on the next agenda date. Rachel Brenner (staff) told the board staff had identified no areas of concern.

- JMS Logistics (TOI 2500031): The board approved a transfer of conditional distribution license T090 from sole proprietorship to J and A Logistics LLC, in which Jason Smith would hold 50% and proposed co-owner April Clyde would hold 50%.

- Wellness Connection of Nevada LLC (TOIs 2500019'100022): The board approved sale of five licenses (C167, P109, D190, RD633 and CLA014) to Retail Facilities Operations Nevada 2 (a Mint Nevada subsidiary) and approved a corresponding waiver of NCCR 5.11 for transfers under 5%.

- Green Mining Concepts / XHale (TOI 2500005): The board approved transfer of cultivation license C093 to Xenergy1 LLC. Staff noted that Exhale (XHale) previously had a roughly $907,000 balance due to the Nevada Department of Taxation; the tax portion has been satisfied and Exhale is contesting $219,866.41 in penalties and interest.

- Unifin LLC management services agreement (MSA 2500003): The board approved an MSA permitting IRBA to provide consulting, accounting, administrative and related services to Unifin during a suitability investigation (TOI 2500041), with staff reporting no areas of concern.

Withdrawals and status checks

Two transfer-of-interest applications were withdrawn without prejudice after prospective buyers were reported nonresponsive or in breach of purchase agreements. Amanda Connor, counsel for NYE Natural Medicinal Solutions, said the company sought withdrawal of TOI 2500018 because the proposed buyer "became non responsive and breached the purchase agreement." The board approved the withdrawal and set a status check for June 2026 to allow time to identify a new buyer.

Similarly, Clark Natural Medicinal Solutions withdrew TOI 2500017, an application tied to a settlement order in disciplinary case 2023-021; senior deputy attorney general Emily Bordelove said the withdrawal affects the board's ability to monitor transfer-progress benchmarks established in the settlement. The board approved the withdrawal without prejudice and continued monitoring via a June 2026 status check.

Postponement of NCCR 11 amendments

Deputy Director Michael Miles told the board staff and licensees have been working to revise sections 61—6 of NCCR 11 (LCB file R152-24) and recommended taking the item off calendar to finish language and forward it to the Legislative Counsel Bureau for approval. The board voted to postpone consideration of those regulatory amendments and scheduled a return at the June 2026 meeting for further review.
