Planning commission recommends six‑month extension for Staggs Leap Section 4 performance agreement

The Hanover County Planning Commission voted unanimously to recommend approval of an extension to the subdivision performance agreement for Staggs Leap Section 4, moving the deadline to Dec. 10, 2025.

Mary Penock, director of planning, told the commission the applicant requested a six‑month extension and that the planning and public works departments have several outstanding items that must be addressed before the agreement can be released. "There are a number of lots where sidewalks have not yet been installed," Penock said, and staff also needs "a copy of the certification statement noting that all monuments have been placed on the property" and repairs to the wet pond and some storm sewer pipe.

County counsel Miss Randolph and Penock explained the consequences of denying the extension: the project would go into default and the county could pull the remaining surety and hire contractors to complete the work. "If the developer was not prepared to immediately fix the problem, then the county would pull the bond and do the work itself," Miss Randolph said.

Commissioner Martin moved that the planning commission recommend approval of BAO2022Dash00024 to extend the performance agreement to 12/10/2025; Commissioner Parker seconded. The motion passed by voice vote with no opposition.

The extension was characterized in staff materials as the first request for this section before the planning commission; staff noted a prior administrative three‑month extension authorized by the director in March had expired. The county will continue to monitor resolution of the planning and public‑works items before final release of the performance agreement.
